These terms of services govern the use of our logistics service(s), including value-added service(s), ad-hoc service(s), third-party service(s) and any other services provided by us (collectively our “Services”).

By engaging our Services, you acknowledge that you have read, understood and agreed to be bound by the Terms of Service and represent that you have read and understood the same.

The Terms of Service represent a legally binding agreement between you (and your client, employer or another entity if you are acting on their behalf) and AB Logistics and its direct affiliates or subsidiary, including the various different entities that AB Logistics uses to operate locally in different countries.

If we have to contact you, we will do so by telephone or by writing to you at the email address or postal address you provided to us.

When we use the words “writing” or “written” in these terms, this includes emails.

Changes to terms

We may amend these terms from time to time by posting the updated terms on our website. If we make material changes, we will notify you of the changes before they become effective. By continuing to use our services after the changes come into effect means that you agree to be bound by the revised policy.

Provisions of services

Our services are provided through our concierge team for the purpose of transportation and delivery of products, goods and cargo internationally within our coverage area and network.

The services provided are but not limited to:

  1. Trucking

  2. Air freight

  3. Fulfilment

  4. Warehousing

  5. Delivery

  6. Reverse logistics

  7. Consulting

Each service provided are bound by the terms set out in this Terms of Service and are universal regardless of routes and services unless otherwise specified.

Each engagement of service shall involve the transportation of goods and products from the origin to the destination (“Shipment”).

Prohibited items

Most of the shipments being handled by us are being put onto passenger aircrafts, we are committed to the safety of our employees, our service partners as well as the general public, as such, you are prohibited to ship with AB Logistics:

  1. Any goods related to illegal activities or which is prohibited by law in the place of origin, the destination, or any sites through which such goods travel.

  2. Any goods requiring specific licenses to store and distribute. Examples of products with distribution and licensing requirements may include but are not limited to:

    • Live plants and animals;

    • alcoholic beverages;

    • ammunition and firearms;

    • tobacco;

    • firearms and weapon of any kind;

    • prescription pharmaceuticals or other dangerous drugs;

    • explosives or hazardous goods;

    • unique or one-of-a-kind materials; and

    • precious metals in the form of bullion or reserves.

  3. AB Logistics shall not be liable for any loss, damage or destruction of such prohibited goods.

  4. When required by law, AB Logistics will be compliant and cooperating with authorities to handover illegal or dangerous goods and reveal information pertaining to the shipper and/or recipient of such goods.

  5. Exceptions can be made, provided ample information and proof of legal rights/licenses or permits are available for review by AB Logistics’ senior management.

Information when shipping

When using our services, you must provide accurate, truthful and up-to-date information about your shipments.

Charges will apply regardless if there are any error in the information provided to us at the time of booking the shipment for shipping.

You agree and declare that the information provided are true. If you are booking the shipment on behalf of a company, business or other legal entity, you represent that you have the authority to bind such entity and its affiliates to the services engaged.

False declaration of export and/or import information is a serious offence and can result in fines and penalties, AB Logistics is not liable for any fines and penalties that is incurred due to the inaccurate supply of information.

Payment

You must provide complete and accurate payment information. Payment for AB Logistics services shall be made by any of the accepted payment methods set out on the invoices.

A shipping fee will be charged for each Shipment, of which shall include all costs related to the Shipment, quoted by AB Logistics (“Shipping Fee”). Shipping Fee shall include shipping costs, fuel surcharges, remote area surcharges, courier tax handling fees, pick-up fees, and any other amount related to the activity of shipping through AB Logistics. You acknowledge and agree that the Shipping Fee do not include any additional fees arising out of separate agreements with third-party service partners.

Quotations for Shipping Fees by AB Logistics are based on the information provided by you, including but not limited to shipper’s address, receiver’s address, weight, dimensions, and value of the goods. In the event that there is a discrepancy between the Shipping Fees charged by AB Logistics due to incorrect information that you provided, such as incorrect weight, dimensions, value of the good(s), addresses, or any other information critical to estimate the shipping cost, you will be responsible for such discrepancy amount. AB Logistics specifically disclaims any liability of any Shipping Fees errors due to inaccurate or incomplete information. AB Logistics is not responsible for any changes or alternation of the Shipping Fees. AB Logistics agrees to make reasonable efforts to bill such discrepancy amount to your account in a timely manner but AB Logistics makes no representations or warranties regarding the amount of time needed to complete processing.

AB Logistics reserves the right to adjust its pricing in response to currency fluctuations, including but not limited to, currency conversion rate changes, conversion fee changes, and/or discount rate changes.

In the event you disagree with any Shipping Fees charged to your account, you shall submit such complaint to AB Logistics within seven (7) days of the fee being charged (“Dispute Period”). AB Logistics will not review customer requests for Shipping Fee adjustments that are received after the Dispute Period.

You acknowledge and agree that all fees, charges and any other rates or amounts charged by AB Logistics to you here under are exclusive of any applicable value-added, sales/use of goods and services taxes (“Transaction Taxes”) which may be levied in connection with the supply by AB Logistics of the services to you. Where applicable, you shall be responsible to pay all Transaction Taxes arising in respect of the Shipping Fees or other amounts charged by Aersure to you.

Clients who incorrectly declare the commodity type and/or value of their shipment(s) may be charged a penalty of up to US$1,000 or the difference between the declared value and the transactional value, whichever is higher.

Limitation of liability

By accepting the Terms of Service, you acknowledge and agree that we do not assume any liability whatsoever for acts, errors, or omissions (including, without limitation, any negligence or wilful misconduct) of you or any third-party service providers with whom you or any of your affiliates may contact, regardless of the purpose.

You are responsible to provide complete and accurate information in respect of the Shipment including but not limited to the goods category and the value of the goods. You shall be responsible for any error, damage or expense or consequence resulting from wrongful or incomplete information to us. You shall further indemnify AB Logistics for and hold AB Logistics harmless from any loss or expense resulting as a consequence of the wrong information provided by you. AB Logistics shall not be responsible for losses or damages in the event that any item contained in the Shipment is wrongfully declared. Moreover, AB Logistics is in no way responsible for any damages or losses due to custom practice. AB Logistics shall not be liable for the accuracy and truthfulness of the information provided by you.

AB Logistics is not liable for any fees, expenses, resulting as a consequence of a change of information from your side (for example change of address, order cancellation, or order call-back), after a Shipment has been confirmed and paid for on AB Logistics. AB Logistics is not liable for any delay in generation of shipping documents.

Any damages or losses incurred during the shipping process with AB Logistics will have a default limited liability of Singapore Dollars 100.00 per parcel (for B2C) OR Singapore Dollars $0.10 per kilogram (for B2B) OR the value of the shipment, whichever is lower.

Disputes

If there are any disputes or disagreements that may arise, AB Logistics is committed to providing you a pleasant shipping experience and would like to proactively resolve them. If you feel that something is not right, you can send an email to contact@ablogistics.co. For the purpose of clarity, this does not waive the notice requirement set fort below.

Governing law and jurisdiction

These terms are governed by and shall be construed in accordance with the laws of the Republic of Singapore.

The courts of the Republic of Singapore shall have exclusive jurisdiction to settle any disoute or claim arising out of or in connection with these terms.

Entire Agreement

These terms constitute the entire agreement between any client and us in relation to the use of or any transactions of our Services. These terms supersede and extinguish all other agreements, promises, assurances, warranties, representations and understandings between any client and us, whether written or oral, in relation to the use of or any transactions of our Services unless otherwise stated.

You acknowledge that you will have no remedies in respect of any statement, representation, assurance or warranty (whether made innocently or negligently) that is not set out in these terms.
